We offer specialized and comprehensive advice in the areas of occupational health and safety law as well as working time law in order to optimally support companies in complying with statutory requirements and minimizing liability risks.
Compliance with the numerous statutory provisions and requirements under the dual occupational safety system, as well as in working time law, calls for in‑depth expertise, which is pooled and applied in a targeted manner within our Practice Group.
We advise on the implementation and optimization of compliance management systems and represent companies, members of corporate bodies and other responsible persons in administrative offences proceedings.

Our key focus areas include, among others:

Occupational health and safety law

  • Development and implementation of occupational safety management systems: We assist companies with the introduction and optimization of integrated management systems that align statutory and employers’ liability insurance association requirements with the company’s safety objectives and ensure sustainable compliance.

  • Support in administrative procedures and fine proceedings: We assist with communications with the competent supervisory authorities and ensure that official inspections and on‑site visits run as smoothly as possible, without unnecessary disruption to your business operations.

  • Challenging administrative fine notices and representation in proceedings: Skilled representation in objection proceedings or before the courts in defending against unfounded sanctions under occupational health and safety law.

  • Legal review and advice on occupational health and safety issues: We analyze and assess all relevant legal questions relating to occupational health and safety and support you in legally compliant implementation in day‑to‑day operations. Where necessary, we work closely with external technical service providers to ensure holistic solutions.
  • Advice on accidents at the workplace and preventive occupational safety measures: Preventive strategies and legal support in the event of accidents lead to greater safety and reduced risk.

  • Risk assessments and technical protective measures: Legal support in creating the framework for the legally compliant preparation and implementation of risk assessments as well as for the selection and implementation of technical and organizational occupational safety measures, considering the co‑determination rights of the works council.

  • Training and awareness‑raising: Legal advice on the design and delivery of occupational safety trainings to sensitize employees to hazards and strengthen awareness of safety regulations.

Working time law

  • Working time law: We advise companies on the legally compliant implementation of the requirements of the Working Time Act, regarding maximum daily working hours, minimum rest breaks and rest periods, work on Sundays and public holidays, night work and shift work, on‑call duties, standby services, trust‑based working time and issues relating to time recording.

  • Road transport: If you employ drivers engaged in the carriage of goods and passengers by road, we also advise you on the complex European and national regulations on driving times, breaks and rest periods and their recording.
  • Working time models: We support companies in designing working time models and accompany negotiations with works councils. Where official approvals are required, we apply for these on your behalf.

  • Compliance management systems: We advise on the implementation and optimization of compliance management systems that ensure compliance with statutory requirements. For the legally secure delegation of management duties, we prepare information sheets and instructions.
  • Training: We train members of corporate bodies and employees in statutory requirements and the legally compliant delegation of management duties.

  • Supervisory authority: We advise and support you during inspections and monitoring measures by the supervisory authority.

  • Administrative offences proceedings: We defend companies, members of corporate bodies and other responsible persons against (impending) orders issued by the supervisory authority, against the imposition of fines and orders for forfeiture and confiscation.

Within our Practice Group, we pool our expertise and many years of experience as lawyers to provide you with tailored, practical advice.
